United Federation LEOS-PBA WINS in Boston as NLRB Overrules Objections & Certifies the Results

Updated: Aug 26, 2023

8/18/2023 - Boston, Massachusetts - The National Labor Relations Board NLRB has made its ruling in Paragon Systems, Inc Case 01-RC-309281 & Case 01-RC-309535 based on two frivolous Objections to the Election filed by SPiT-FA on June 12th, 2023,

The objections are as follows: 1. The voter list that the Employer served upon the parties did not comply with the requirements set forth at Section 11312.1 of the NLRB Casehandling Manual for RC cases. The voter list font for much of the content in this case is Times New Roman 8; the Board Rules and the DDE require no smaller than Times New Roman 10.

2. Petitioner LEOS posted a photo of a ballot in this case on its website which had been altered and did not contain language that affirmatively stated: “The National Labor Relations Board does not endorse any choice in this election. Any markings that you may see on any sample ballot have not been put there by the National Labor Relations Board.”

"Based on the foregoing, having considered Intervenor SPiT-FA's offer of proof in the light most favorable to them, I find their offer of proof is insufficient to warrant setting aside the election. I am, therefore, overruling Intervenor SPiT-FA’s objections in their entirety and hereby issue the following Certification of Representative based on the tally of ballots that previously issued at the conclusion of the election."

On Friday, August 18, 2023, the National Labor Relations Board NLRB had overruled the Objections to the Election filed by SPiT-FA in its entirety whereby Paragon PSO’s in Boston, Massachusetts's voted overwhelmingly by a score of 36 to 18 to join our Union, United Federation LEOS-PBA Family Pride. This victory is an important reminder for workers everywhere that union solidarity and collective action can produce large-scale results.

BREAKING NEWS

The United Federation LEOS-PBA has successfully negotiated a new CBA on behalf these Paragon Boston PSO's within a matter of a few days from the certification of this election by the NLRB beating the August 31st deadline which is the cutoff date the Employer has to submit its CBA to the federal government in order for these Paragon Boston PSO's to get a raise for October 1, 2023. Under the previous Union, SPiT-FA had FAILED to negotiate a new CBA which expired back on March 15th 2023. Because of SPiT-FA's FAILURE to negotiate a new CBA over the last 5 months these Paragon Boston PSO's were in jeopardy of NOT receiving a wage increase this year.

"Under the New 3 year United Federation LEOS-PBA / Paragon Boston CBA these Boston PSO's will now receive the highest wage increase they have ever seen, a 11.8% total wage increase which amounts to a $2.73 cent wage increase come October 1st vs the typical $0.95 cent wage increases they were receiving under SPiT-FA as well as a $0.57 cent increase in their H&W for a total wage increase of three dollars & thirty cents ($3.30) wage increase." Noted United Federation LEOS-PBA President Charles Chip Strebeck.

"In addition to the above our Union was successful in increasing the Secret Posts from $0.75 to $1.50 and $2.00 to $3.00 for Top Secret Post, better payouts on Vacation upon completion of ten (10) years of service vs fifteen (15) years of service, better gas milage reimbursements, and a number of additional language changes that will better protect our new Paragon Boston PSO's rights." noted Strebeck.

On July 31st, 2023 the 93 Transportation Security Officers (TSO's) working for ISS Action in Arizona voted overwhelmingly by a score of 51 to 11 to leave their current Union, SPiT-FA to join our family pride, United Federation LEOS-PBA Law Enforcement Officers Security & Police Benevolent Association.

On August 1st, 2023 our Union United Federation LEOS-PBA had just filed an election to represent the 150 Paragon PSO's in Hawaii, Guam, Saipan & American Samoa. In this election knowing full well their fate, awaits them, SPiT-FA is refusing to sign a stipulated election agreement between the parties outlining election details. Based on the above refusal actions by SPiT-FA this petition is now scheduled for a NLRB hearing later today @ 9:00 am Hawaiian time.

"Once again because of SPiT-FA fearfulness of losing another election to our Union, SPiT-FA is wasting the taxpayers and governments money by forcing this election to a NLRB hearing vs just agreeing to allow the these Paragon PSO's in Hawaii, Guam, Saipan & American Samoa to have their Voices heard."
"What is SPiT-FA President David L. Hickey so afraid of?" Noted United Federation LEOS-PBA President Charles Chip Strebeck.
